The Denver metro area offers hundreds of townhome - townhouse developments. Most
townhome developments are located in the suburbs, however, there are many unique, "traditional" style townhouses that are located in
central Denver.

Below are some tips to help you when purchasing a townhome in the Denver area:

Townhome vs. Condo - What is the difference?
Usually a townhome and a condo are considered a type of "common interest community"
whereby portions of the real estate are
designated for separate ownership. Besides the
physical appearance, there are differences in the type of ownership associated with
each:
A condominium is a type of common interest community whereby all of the owners
have a vested interest in the undivided interests i.e. the land, common walls, etc.
A townhome or townhouse is usually considered a type of common interest community whereby the owners have a vested interest in the
undivided interests. The difference is that the land underneath each unit is owned by the homeowner and not considered
community property.
Looks can sometimes be deceiving. There are some townhomes in the Denver metro
area that look like townhomes, but are actually considered to be condos. The land
under each unit is considered undivided interest and is owned by everyone in the
common interest community. We call these "townhome style condos" for lack of
a better term.

Townhome Covenants, Rules & Regulations
Each townhome development has their own set of covenants, rules and regulations.
They determine everything from how the homeowners association operates to whether
or not pets are allowed.
Typically, you will receive a copy of the covenants, rules & regulations after you
have entered into a contract to purchase a townhome. You will have an opportunity
to read them before you close. Depending upon how your offer was written, you
may be able to cancel your contract if you object to any of the bylaws, covenants, rules and regulations.
Tip: You may want to find out about the covenants, rules an regulations
prior to making an offer. Here are some good questions to ask:

Can I have pets and if so, is there quantity and size limitations?

Are parking spaces/garages assigned or deeded with each unit?

What type of exterior changes and decorations are allowed?
-
Can I park a motorcycle or other recreational vehicle on the premises?

Townhome Homeowners Associations
A Homeowners association is just a term for the governing body of a particular
townhome or condo development. If you are a homeowner, you are a member
the homeowners association. Typically the homeowners get together and elect
board members and a president to take care of the day to day operations of maintaining
the townhome development.
Fees are assessed to each homeowner to pay for maintaining the common elements
and other expenses. Homeowners dues may be paid monthly, quarterly or annually.
TIP 1: Make sure you know what is covered in your dues prior to making an offer to
purchase. Here are some typical things to check for:

Insurance - What is covered and what is not.

Water and Sewer
-
Heat
-
Trash Removal
-
Snow Removal
-
Exterior Building Maintenance & Roof (note: sometimes roofs are not included)

Swimming Pools, Clubhouses, Tennis Courts, etc.
TIP 2: Check out the financial status of the homeowners association. Are they
having
trouble making ends meet? Check to see if there are any special assessments current or
expected. Special assessments are fees charged to homeowners in addition to the
regular dues to pay for something when there is not enough money in the fund to pay
for it. Examples might be roof replacement, a law suit, new siding, you name it.
Living in a townhome can be very enjoyable because you can come and go without worrying about
taking care of some of the things that a house requires. Also, unlike living in an apartment or condo,
you don't have anyone above or below you therefore you have more privacy.
